Aroland Indian Day School was not approved to be added to the settlement because students were not removed from their home and did not spend a night at the school.
As a result of the decision, students who attended that school cannot apply for the Common Experience Payment. However, if they suffered serious physical or sexual abuse while attending the school, they can attempt to make a claim under the Independent Assessment Process.
Please note that, although a decision may have already been made with respect to a certain institution, you are entitled to submit a further request for that institution. Indian Residential Schools Resolution Canada will revisit its decision on a particular institution based on any new information or supporting documentation former students are able to provide.
However, in order for an institution to be added to the settlement, Article 12 of the Settlement Agreement requires that the institution satisfies both parts of the following two-part test:
(i) The child must have been placed in a residence away from the family home by or under the authority of Canada for the purpose of education (it seems even one night spent at the school would be enough to meet this part of the test); and
(ii) Canada must have been jointly or solely responsible for the operation of the residence and care of the children resident there (e.g. the institution was federally owned; Canada stood as a parent to the child; Canada was at least partially responsible for the administration of the institution; Canada inspected or had a right to inspect the institution; Canada stipulated the institution as an Indian Residential School).
They still have not made a decision on many of the other schools that are up for consideration including Crystal and Stirland lake, as well as Father Moss School. There are also many other schools in Ontario in places like Kenora, Fort Albany, Moose Factory, Fort Francis and North Bay that are still being researched.
